國防大學學生阿立（化名）在健康檢查中得知感染愛滋，校方禁止他上游泳課，並要求餐盤分開清洗，最後校方更以頂撞師長為由予以記過退學。為此，衛福部向校方提出行政訴訟，引起社會關注。據軍方高層知情人士表示，該生退學跟愛滋被混為一談，退學純粹是品德因素。
有關阿立疑似因愛滋遭到國防大學退學一事，疾病管制署積極爭取愛滋感染者就學權益案，甚至驚動聯合國愛滋病組織（UNAIDS）來信關切，表態支持疾管署捍衛病患免於歧視的行動，並提供國際相關判決。
為了保障愛滋病患的權益問題，疾管署今天決定先對國防大學開罰100萬元，目前已進入行政程序，若國防大學遲未改善，未來將可連續開罰。
不過，國防大學政戰主任蔡承棟15日上午表示，該生遭到學校退學，主因是在校期間多次違反校規，品德成績並未達到成績標準，與愛滋毫無相關。
據軍方高層知情人士私下表示，衛福部與疾病管制署將愛滋與退學事件混為一談，軍人訓練品德尤其首要，軍紀如山不得隨便，而該生在校多次觸犯校規，記過紀錄可以證明，成績無法達到標準。
至於國防大學上午發出的書面聲明稿也指出，該生在校期間因為有違反資訊安全相關規定，遭到懲處，而其年度德行成績未合格，在經過獎懲評議委員會決議後予以退學，強調各項程序皆合乎規定，並非外界指稱所謂因愛滋而退學。
